This privacy policy explains the way in which FABinMOTION (“Us” or “FAB”) collects, manages and uses personal information volunteered by individuals and clients who use our services such as visitors and users of our websites, email and social networks operated or managed by FAB (referred to hereiunder as the “website”), visitors, users and clients of our services (referred hereinunder as “you”).

Processing and treatment of personal data and information by organisations is regulated and as such we must obtain your consent before performing certain operations. By agreeing to the present policy while volunteering personal information, you consent to FAB the right to collect, use, communicate, conserve and destroy said information as set forth by thos policy.

If you would rather not consent such right to FAB, you must cease using the website or other applicable FAB services. FAB follows best practices relative to security, respect of privacy and protection of personal data. FAB considers it top priority to ensure the protection and confidentiality of any personal data supplied by you.

1. Perconal data collection Within the context of our services, FAB needs to collect information allowing it to identify physical persons having a business relationship with us. The type of data collected is context-dependent, as described hereinunder. FAB only collects the necessary data to conduct business within its realm of activities. We only collect personal information and data volunteered to us by persons and corporations through our website (for instance when you fill out a form), or through other channels (such as email or mail you send us). This data may include any of the following:

• Phone number(s)
• Physical address
• Country, province or state of residence
• Profession
• Your purchase orders, including loans
• Training given by FAB
• Any information volunteered by you through the use of the website, chat, email of phone

FAB can also collect personal data from other sources, such as its partners and subcontractors.

Data related to payments:

We do not collect data from your credit or bank cards. Payments made through our website are processed by a third-party (PayPal) and any card information is solely used and managed by it. The security of all transactions are ensured by the third-party (PayPal), following industry best practices.

Automated data collection:

FAB collects certain information automatically through tools such as web cookies and Google Analytics when you use the website. This data may include any of the following:

• The configuration of the browser and operating system of the client computer
• The configuration of the mobile device used to access the website

We do not trnasmit personal information to services sich as Google Analytics.

Some cookies are deleted upon closing your browser, while others are kept indefinitely or until you expressly delete them. You may deny the use of cookies through the preferences settings of your browser. However in ths case the website may not fonction properly and your user experience may be degraded.

INteracting with FAB through social networking websites: We may also collect some data through social networking websites (such as LinkedIn or Youtube) when a visitor interacts with one of the profiles held by FAB on these platforms. These services are third-party and as such have their own applicable privacy policies which could differ from this one. Should you wish to interact with us through these platforms, you are required to read and agree to their specific policies.

Links to third-party websites:

Our website may contain links to external third-party websites provided for convenience. When you clic on these links, you leave our website. FAB has no control over third-party external websites and furthermore has no control over their privacy practices. As a result, it is your responsibility to read and accept (or not) their policies in order to protect your personal data.

2. Use of personal data by FAB:

We collect and use your personal data for the following purposes

• To manage your transactions with FAB
• To provide client accounts to persinalize and facilitate your use of the website
• To store your preferences, particularly with respect to your preferred products and services, and to suggest products and services that may be of interest to you

• To respond to your requests concerning our prooducts and services
• To communicate with our clients
• To receive and process service calls from our clients
• To communicate with our clients relative to our products and services
• To inform our users of any applicable news, updates special offers and promotions while respecting all current anti-spam regulations

• To perform analysis on our visitor’s behaviour on our website
• To identify and correct technical problems with our website

3 – Storage of personal information:

FAB will keep all collected personal data as long as deemed necessary to conduct its activities and to reasonably fulfill determined purposes such as customer service and legal or commercial requirements .

The duration of the storage depends on the products or service and the nature of such data. Upon exoiration of the conservation period, data will be either deleted, destroyed or de-personalized. We cannot however commit to any specified period of time except where required by law.

Depending on the type of data, it can be stored either on FABs servers, offices, or at the facilities of designated services suppliers or subcontractors.

In certain cases, FAB could do business with subcontractors outside Québec. FAB will take reasonable measures to ensure said contractors will process personal data held by FAB according to the present policy and applicable laws.

When allowed by law, you may at any time terminate your consent to the collection processing and storage of your personal data. In this case, FAB could be limited in the extent of products or services it can offer you. In some cases, FAB could even be forced by law to not offer certain services. FAB could also be obligated by law to keep certain data for specified periods, for instance for auditing, tax and accounting purposes.

4. Confidentiality of personal data:

FAB considers all personal data as sensitive and confidential. Security and protection of personal data is a top priority for FAB. FAB takes reasonable physical, contractual, administrative and technical measures to protect your personal data against unauthorized use, loss or theft, including by encryption where applicable. Despite such efforts and measures, it is impossible to guarantee 100% security. As such users of our website and related services recognize the risk associated with volunteering personal information over the internet or by other electronic means and assumes full responsibility in the matter.

5. Communication of personal data Unless specified by this policy, FAB will not sell, rent, distribute or communicate to other persons or organisations any personal data collected from you.

FAB personnel and other users:
Personal data collected by FAB will be accessible to it’s management and selected employees for the sole purpose of performing the tasks set forth by this policy. Any personnel with access to personal data within the FAB organisation agrees to use such data solely in accordance with this policy.
Furthermore, some data may on occasion be shared with third parties acting as subcontractors or suppliers to FAB, In this case, these parties will agree to preserve the confidentiality and security of such data and to use it solely for the purposes set forth by this policy and within the context of their contractual obligations towards us..

Restructuring
In the event where a company operated by FAB is sold or restructured, we may share your personal data with parties concerned with the transaction, before, after and even if the transaction never comes to fruit. In such an occurrence, we will demand a firm commitment from such parties towards the preservation, safekeeping and use of the data, exclusively within the context of the transaction and according to the dispositions set forth by this policy.

Legal requirements
FAB may share or communicate your personal data to other persons or organisations if required by applicable laws or regulations, even without your consent. FAB may communicate such data if ot is deemed necessary to protect it’s rights, posessions and security of itself, it’s personnel and other parties, to comply with legal audits and to ensure clients’ compliance with their obligations towards FAB.

6 – Access to personal data

Some of your personal data held by FAB are accessible through our website and may be modified by you by logging onto the website. Furthermore, you may access all your personal data held by us and request updates or corrections in writing to:

We will honor if possible any such request within 30 business days following it’s reception. We will provide reasonable access to your data according to applicable laws and regulations. Certain fees may be applicable. We will confirm the identity of anyone making such a request. Data collected for this specific case will not be stored or used for other purposes. FAB will deploy reasonable efforts to ensure the data it holds about you is accurate and up-to-date. It is however your responsibility to ensure currency and accuracy of the data you submit to us.

7. Unwanted messages and spam:

FAB respects current laws and regulations relative to unsollicited communications (spam). If you no longer wish to receive electronic communications from us, or if you feel you have received inapropriate or unsollicited communications from us, please follow the unsubscription mechanism included at the bottom of ous messages. We still retain the ability to communicate with you to fulfill your orders and requests, according to current regulations and law.

8. Modification of this policy:

This policy can be modified to better reflect the industry’s and FAB’s evolving best practices in the processing of personal data. In this case, FAB would take reasonable steps to keep you informed of such changes inasmuch as we have an email address to contact you with. If we do not have your email address, you are invited to regularly check the online version of this policy for any changes.

9. Applicable laws and regulations:

The processing of personal data and information is regulated by applicable laws in different jurisdictions. This policy concerning the confidentiality of personal information and all related operations shall be governed by the laws of the province of Québec and the applicable laws of Canada and shall be interpreted according to these laws given that FAB does business in Canada.
