This clause applies to any intervention, advice, training, or parts supply related to the equipment [CNC Machine Name] (hereinafter “the Machine”).
2. Exclusion of Performance and Production Guarantee
Performance: The provider/supplier does not guarantee any specific level of performance, production speed, or finish quality. Actual performance is highly dependent on operator skill, environmental conditions, and maintenance.
Machining Results: Final dimensions, tolerances, and surface finishes are the sole responsibility of the user.
3. Limitation of Liability for Mechanical and Electrical Failures
Breakdowns: The supplier is not liable for mechanical, electrical, electronic, pneumatic, or hydraulic failures resulting from improper use, lack of maintenance, overloading, or unauthorized modifications.
Programming: Programming errors (G-code), parameter setting errors (speed, feed), or design errors (CAD/CAM) that result in damage to the machine or its parts are the sole responsibility of the user.
4. Maintenance and Safety
User Responsibility: The user is responsible for establishing and adhering to a rigorous preventive maintenance plan (lubrication, calibration, electrical verification) to ensure the safety and longevity of the equipment.
Compliance: The user is responsible for ensuring the installation complies with applicable safety standards (e.g., Machinery Safety – CNESST).
